Conflicto de competencia suscitado entre el Juzgado Promiscuo Municipal de Aracataca, el Juzgado Civil del Circuito de Fundación y el Juzgado Veinticinco Laboral del Circuito de Bogotá.
La controversia se generó por las diferentes interpretaciones que del factor territorial hicieron los despachos judiciales involucrados.
Considera la Corte que el juzgado competente para resolver la solicitud de amparo es el de Aracataca, no sólo porque fue el elegido a prevención por el accionante, sino porque fue a quien se le asignó el trámite de tutela en primer término.
Se dispone enviar el expediente a dicho despacho judicial, para que de forma inmediata tramite y adopte la decisión de fondo que corresponda.

- Primero. DEJAR SIN EFECTOS el auto del 18 de septiembre de 2017, que profirió el Juzgado Promiscuo Municipal de Aracataca (Magdalena), mediante el cual se declaró incompetente para conocer de la acción de tutela presentada por Felipe Villa Ramírez contra la Secretaría de Tránsito y Transporte de Aracataca (Magdalena).
- Segundo. REMITIR el expediente ICC-3080 al Juzgado Promiscuo Municipal de Aracataca (Magdalena), para que, de forma inmediata, tramite y profiera decisión de fondo respecto del amparo solicitado.
- Tercero. Por Secretaría General, COMUNICAR a los Juzgados Civil del Circuito de Fundación (Magdalena) y Veinticinco Laboral del Circuito de Bogotá, la decisión adoptada en esta providencia, así como a las partes del proceso de tutela.
